This presentation attempts to answer how referring and/or national judges use the rulings of the Court of Justice of European Union (CJEU) relating to free movement law to solve private law disputes concerning the execution of a contract. It considers the general context and concentrates on Italian and Polish case law. It aims at detecting how the general principles developed by the CJEU influence civil law relationships between individuals in an ‘old’ and a ‘new’ Member State.
